RE: LETTER OF COMPLAIN AGAINST BAUCHI STATE SHARI’AH COMMISSION, DA’AWAH ISLAMIC EDUCATION & ONE MALLAM MUSA FOR WRONGFUL CONFINEMENT & FORCEFUL CONVERSION OF13 YEARS OLD GIRLS TO ISLAM:
Prison Inmate Development Initiative (PIDI) is a Non-Governmental organization, with the sole aim of promoting access to Social Justice, Security, and Information on Crime Management & Control, Education, Rehabilitation, Conflict Resolution, Strategies alliance and to create enlightenment among members of the society on government activities. The function of the Nigeria criminal justice system, includes; rights and welfare of the marginalized vulnerable groups to ensure equal protection. PIDI is a Member; Human Rights Agenda Network (HRAN), Centre for African Human Rights (CEHURI), Coalition of Northeast Human Rights Defenders (CNHRD), Child Protection Network (CPN) and Nigeria Coalition for International Criminal Court (NCICC) and among others.
We hereby write again to the National Human Rights Commission (NHRC), for prompt action to stand as Defenders to the guardian family of Mrs. CHARITY SAMSOM GOBET, a (widow) for their fundamental human rights as enshrine in 1999 constitution of the federal republic of Nigeria. In respect to this incident:
1. It is in the statement of the victim guardian Complaint in our office (PIDI) dated 8th January, 2016; at about 3:01pm.
a. As enclose that he (complainant) resides in Yelwa Sabon Kaura in Bauchi LGA, in Bauchi State.

.b. That she has a cousin sister, one Progress Jacob, 13 years old, who sometime in August graduated in primary school at Yelwa Sabon Kaura of Bauchi LGA, Bauchi State.
c. That her cousin Progress Jacob is an Indigene of plateau State from Kanke LGA, Dawaki of Gudum village.
d. That she Left home on the 3rd day of January 2016 at about 8:40 am in the morning which was Sunday that she was going to church.
e. That on a normal ground her church started around 8:00 am to 10:30 am which mean she ought to be home any time from 11:00am.
f. That at that very day to them it was a surprised, that they waited till around 12:00 pm but she did not return home.
g. That after some time their Mum (Mrs. Charity Samson Gobet) called their younger brother who was outside the house at that very moment and asked him to go and check the church if his cousin sister (Progress Jacob) the missing girl was there but unfortunately he could not find her.
h. That on the 4th day of January 2016 been Monday the family informed the Nigeria Police Force on the incidence at Yelwa Police Division, and the police told them that they are going to investigate over the issue and asked them that they should keep on searching for her.
i. That on the 5th January, 2016 her younger brother was passing then he asked a girl about progress and her response was that she saw her passing the same area on the 4th January 2016.
j. That when he got home he told them everything that happened; still they continued their search for her.
k. That after much search of her cousin sister Progress Jacob, she decided to report at her place of work which is Hiltop international model academy located at sabon kaura.
l. She resumed work on the 7th of January 2016 and informed her principal and her colleagues about the problem they are facing in her family.
m. That on that very day after working hours she was passing then she met a girl whose name was Zara’u Ayuba who is between the age of 11yrs old and resides at Sabon Kaura, she asked her the whereabout of Progress.
n. That the girl Zara’u, told her she saw her with a girl name Hadiza who also resides at Sabon Kaura both of them were passing and progress was putting on Hijab.
o. Then she asked her to take her to Hadiza’s house, she took her there and she entered the house but Hadiza was not at home.
p. Then she saw Hadiza’s father and told him why she was at his residence but before she concluded he said to her aggressively that there was no girl in his house.
q. That after she left and went home she narrated the story to her mum then she called their neighbour who is a policeman and told him what was on ground, she then called her elder brother who is a custom officer and told him what was happening.
r. That they were advised to go back and report the case to the Nigeria police force which they did so.
s. That before then they had reported the case to the king who is in charge of Sabon Kaura community about the issue but he did not take the issue serious.
t. That when they got to the police station a woman police was assigned to take up the case, from the police station we went to Zarau’s house and asked her to accompany us to Hadiza’s house.
u. That on their way going the policewoman asked Zarau if she was sure of what she said and she said yes.
v. When they got there they asked Hadiza and her father one Mallam Musa to follow them to the station for further investigation but they were reluctant but after briefing them about the whole thing they decided to follow them.
w. That In the police station, Zarau was interrogated and she said she saw the girl, and then other people were also investigated.
x. On the 8th day of January 2016 some people came with a letter in the present of our (PIDI) Human Rights Monitor at the police station which they claimed that is from a young girl who wants to convert to Islam.
y. The family ignored them until their attention was called the following day by the Deputy Superintendent of police (DSP) Yelwa Division.
. PIDI Human Rights Defendants went to the police station with the victim’s Family, and DPO of the Police Division Yelwa handed a letter to the Family of Progress Jacob from Bauchi State Shari’ah Commission and the letter was about the missing 13 years old girl who wants to convert to Islam. In his statement he said that the case is beyond the Nigeria Police Force.
IT IS our submission that every Child is entitled to equal protection of the law, without discrimination on any grounds, and especially against violence and other threats to both the minor and her family; and that of their fundamental human rights as enshrines in chapter four (4) of the 1999 constitution of the Federal Republic of Nigeria. Sir, we urge you to consider the following, base on our investigation:-
7. Freedom of thought, conscience and religion
(1) Every child has a right to freedom of thought, conscience and religion,
(2) Parents and, where applicable, legal guardians shall provide guidance and direction in the exercise of these rights having regard to the evolving capacities and best interest of the child.
(3) The duty of parents and, where applicable, legal guardians to provide guidance and direction in the enjoyment of the right in subsection (1) of this section by their child or ward shall be respected by all persons, bodies, institutions and authorities.
(4) Whenever the fostering, custody, guardianship or adoption of a child is in issue, the right of the child to be brought up in and to practice his religions shall be a paramount consideration.
Right to private and family life
(1) Every child is entitled to his privacy, family life, home, correspondence, telephone
conversation and telegraphic communications, except as provided in subsection (3) of this section.
(2) No child shall be subjected to any interference with his right in subsection (1) of this section,
except as provided in subsection (3) of this section.
(3) Nothing in the provision of subsections (1) and (2) of this section shall affect the rights of parents and, where applicable, legal guardians, to exercise reasonable supervision and control over the conduct of their children and wards.
a. That there is a clear violation of threat to life and rights to dignity of human person; (Chapter 4 Section 33 and 34).
b. That there is clear violation of family and private life; (Chapter 4 Section 37).
c. That there is a clear violation of liberty, prima facie offence of wrongful restrain and wrongful confinement; (Chapter 4 Section 35).
d. That there is a clear violation of freedom of movement, prima facie offence!! (Chapter 4 Section 41). And
e. That there is clear indication of child abuse; The child rights Act was adopted in Nigeria in 2003 and UN convention on the Rights of the Child (1989), which has been signed by over 190 countries including Nigeria.
aa. In light of the above background, and in order to be able to effectively ensure equal protection in the incident. We hereby humbly and respectfully apply for the probe underline reference and herein after annex are enclose on other related cases still in there custody by the same perpetrators.
